A $2.9 million class action settlement has been reached in Rabinowitz et al. v. Colgate-Palmolive Company et al. over allegations that Tom's of Maine and parent company Colgate-Palmolive engaged in deceptive and misleading business practices related to certain Tom's of Maine toothpaste products.
What Happened?
In May 2024, the U.S. Food and Drug Administration (FDA) inspected Tom's manufacturing facility in Sanford, Maine. The FDA raised concerns that conditions at the facility did not comply with Current Good Manufacturing Processes (cGMP). The inspection report indicated potential issues with water used in production, which may have been contaminated with harmful bacteria — potentially leading to microbial contamination in finished toothpaste products.
Multiple class action lawsuits were filed, alleging that consumers were misled about the safety and quality of Tom's of Maine toothpaste products. Tom's of Maine and Colgate-Palmolive deny all wrongdoing but agreed to settle to avoid the costs and risks of continued litigation.
